An Overview of DWI in Texas
In Texas, a DWI, or driving while intoxicated, is defined as operating a motor vehicle with a blood alcohol level of .08% or more. A DWI is different from a DUI, in that it is a more serious offense charged under the Texas Penal Code. A DUI is charged under the Texas Traffic Code, and is only issued to minors who are driving with any amount of alcohol in their system. Usually, a person is stopped by the police for a DWI after they have given the officers probably cause (which in this case would be obvious signs of impairment, including erratic starts and stops of the vehicle, weaving, and ignoring posted traffic signs).
The driver may then be given a series of tests to determine whether they are intoxicated or not. These can include a breathalyzer test, a blood test, or a field sobriety test. If it becomes apparent that the driver is indeed under the influence, they are placed under arrest. The penalties for a DWI can vary depending on the individual's prior offenses and the circumstances of their case, but in almost every instance their driver's license is suspended or revoked.
